1. Introduction
These Terms and Conditions govern your access to and use of the HotelSystem platform and associated services. By creating an account or using any part of the platform, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, you must not use the platform.
2. Definitions
'Platform' refers to the HotelSystem cloud-based property management software and all associated tools and services. 'User' refers to any individual or entity that accesses or uses the platform. 'Company' refers to HotelSystem and its operators. 'Subscription' refers to a paid access plan granting use of the platform for a defined period. 'Content' refers to any data, information, or material submitted to the platform by users.
3. Eligibility
To use the platform, you must be of legal age and have full legal capacity in your jurisdiction. By registering, you confirm that the information you provide is accurate and complete. You are responsible for keeping your account details up to date. The platform is intended for professional and commercial use by accommodation operators and their authorised staff.
4. Account Registration and Security
You are responsible for maintaining the confidentiality of your login credentials. Any activity that occurs under your account is your sole responsibility. If you suspect unauthorised access to your account, you must notify us immediately at [email protected]. We reserve the right to suspend or terminate accounts where there is evidence of unauthorised use or breach of these terms.
5. Subscriptions and Billing
Access to the platform is provided on a subscription basis. Subscription fees are billed monthly or annually depending on your selected plan. Fees are non-refundable except where required by applicable law. We reserve the right to modify pricing with reasonable notice. Continued use of the platform after a price change constitutes acceptance of the updated pricing. Failure to pay subscription fees may result in suspension of access.
6. Acceptable Use
You agree to use the platform only for lawful purposes and in accordance with these terms. You must not use the platform to store, transmit, or distribute unlawful, harmful, defamatory, or fraudulent content. You must not attempt to gain unauthorised access to any part of the platform, its servers, or connected systems. You must not use the platform in any manner that could disrupt, damage, or impair its functionality or availability for other users.
7. Intellectual Property
All software, content, design, and materials that form part of the platform are the property of HotelSystem or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for its intended purpose during your active subscription period. You must not copy, reproduce, reverse engineer, or distribute any part of the platform without our prior written consent.
8. User Content
You retain ownership of any data or content you upload to the platform. By using the platform, you grant HotelSystem a limited licence to store, process, and display your content solely for the purpose of providing the services. We do not claim ownership over your data and will not use it for any purpose beyond service delivery and platform operation.
9. Service Availability
We aim to maintain high availability of the platform at all times. However, we do not guarantee uninterrupted access and accept no liability for downtime caused by maintenance, technical failures, or circumstances beyond our control. We will make reasonable efforts to notify users in advance of planned maintenance periods.
10. Limitation of Liability
To the maximum extent permitted by applicable law, HotelSystem shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the platform, including but not limited to loss of revenue, loss of data, or business interruption. Our total liability in connection with the platform shall not exceed the total subscription fees paid by you in the twelve months preceding the event giving rise to the claim.
11. Termination
Either party may terminate the subscription at any time in accordance with the applicable notice period for your plan. Upon termination, your access to the platform will cease and your data will be retained for a limited period as described in our Privacy Policy before being permanently deleted. We reserve the right to terminate access immediately where there is a serious breach of these terms.
12. Changes to These Terms
We may update these Terms and Conditions from time to time. Where changes are material, we will notify you by email or through the platform with reasonable notice before they take effect. Continued use of the platform following notification of changes constitutes your acceptance of the updated terms.
13. Governing Law
These Terms and Conditions are governed by the laws of Greece. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of Athens, Greece.
